There is a prima facia case that Wayne Keith Goss, while Premier of Queensland, in Australia, acted in consort with other criminal members of the Queensland labor cabinet on 5th March, 1990 to make the criminal decision to shred the Heiner Documents. This is called the 'Heiner Affair'. These documents were required as evidence, for a legal case, court case. This criminal labor cabinet header by Wayne Goss did this to protect pedophiles in government departments abusing children under state government 'care'.

Every director has a Fiduciary Duty. This enlivens his mind to consider the evidence. The director must be alert and vigilant to consider any matter that may have an impact or impinge in any way upon his company, and its fortunes. As explained in the various pages viz:

his 'standards' or lack of standards, may have an impact in many ways, on many companies, in particular:

The decision the director must make is in the nature of a 'judicial decision', but he is not required to give any person or entity, 'Due Process', aka Natural Justice aka Procedural Fairness, in particular the 'Right to be Heard'.

Additionally, a Director cannot defer to another or others, for instance, Courts of Law, to make the decision for them. Their Fiduciary Duty will not permit that. The nature, and purpose, of the decision is very different. The director is the 'investigator, prosecutor, judge and jury', by himself. Additionally, although the matter about which he is to make a decision may be criminal in nature, the director is not required to apply the 'criminal Quantum of Proof', of 'beyond reasonable doubt'. Further, it is submitted, the 'Quantum of Proof' required, is not even the 'civil Quantum of Proof' of 'on the 'balance of probabilities' or 50% ie 'more likely than not', but rather far less.

Because of each director's Fiduciary Duty his role is 'protective in nature'; protective of the companies assets. That means that the director must not accept any unnecessary risk. The director must not permit his company to accept any risk other than undiversifiable risk for which the company is rewarded by greater return, from the 'market', as determined by the 'Capital Asset Pricing Model' [CAPM].

It is submitted that because of the protective nature of the Fiduciary Duty, the director must not accept the risk if it is no more than merely 'raised on the evidence'. This would be far less than a prima facie case in a criminal matter. Reference to the applicable law, and view of Sir Harry Gibbs (former Chief Justice High Court of Australia) discloses that there is a prima facie case. All the necessary evidence and law to show that better than a prima facie case exists, is clearly available at http://HeinerAffair.info /.

I suggest that it is extremely courageous, even fool hardy; for those directors of Goss's Companies ie Ausenco Limited and Free TV Australia Limited, or their subsidiaries, to remain in those positions while Wayne Goss retains his position as Chairman of Ausenco Limited and Free TV Australia Limited, respectively. Likewise, directors of any company, that its directors permit to trade with any one of the 'Goss companies', have not fully considered the implications of their actions.
